Release of Liability, Waiver, and Assumption of Risk

In exchange for being allowed onto land leased by ________________ (the "Club") from ________________ (the "Landowner") in ________________ County, ________________ (the "Property"), for hunting and related activities, I agree to the following.

1. Assumption of risk

I understand that hunting and being on rural land involve inherent risks that can cause serious injury, death, or property damage. These include firearms and archery equipment, elevated stands and falls, uneven terrain, water, wildlife, insects, weather, vehicles and ATVs, and the acts of other hunters. I knowingly and voluntarily accept all of these risks.

2. Release and waiver

To the fullest extent permitted by the laws of ________________, I release and waive any claims against the Landowner, the Club, and the Club's officers and members for injury, death, or property damage arising from my presence on the Property, including claims based on their ordinary negligence. This release does not apply to gross negligence or intentional misconduct.

3. Indemnity

I agree to indemnify and hold harmless the Landowner and the Club from any claims, costs, or damages caused by my actions or by any guest I bring onto the Property.

4. Rules and safety

I have read and will follow the Club rules and all hunting laws. I will use a full-body safety harness in elevated stands and wear hunter orange as required by law. I am physically able to take part in hunting activities.

5. Medical treatment

I authorize emergency medical treatment for me if I am unable to consent, and I am responsible for its cost.

6. Entire agreement

This release binds me, my heirs, and my estate. If any part of it is unenforceable, the rest remains in effect. I have read this document, understand it, and sign it voluntarily.

What a waiver can and can't do

A waiver documents that the hunter understood the risks and agreed not to sue over ordinary accidents. Courts in different states treat waivers very differently: some enforce them, some read them narrowly, and almost none excuse gross negligence or intentional harm. A waiver works best alongside, not instead of, hunting lease liability insurance.

Tips

  • Have every member and every guest sign, every season, before they hunt.
  • Have a parent or guardian sign for anyone under 18.
  • Keep signed copies for as long as your attorney recommends.
  • Make sure the waiver names both the club and the landowner.
