Hunting Lease Agreement
This Hunting Lease Agreement ("Agreement") is entered into between ________________ ("Landowner") and ________________ ("Lessee"), acting through its authorized representative.
1. Property
Landowner leases to Lessee the exclusive hunting rights on approximately ________________ acres located in ________________ County, ________________, as shown on the map or legal description attached as Exhibit A (the "Property"). This Agreement grants hunting rights only and does not transfer any other interest in the land.
2. Term
This Agreement begins on ________________ and ends on ________________, unless terminated earlier under Section 12. Any renewal must be in writing and signed by both parties.
3. Lease payment
Lessee will pay Landowner ________________ dollars for the term, due on or before ________________. Hunting rights do not begin until payment is received. Payments are non-refundable except as stated in this Agreement.
4. Permitted use
- The Property may be used only for lawful hunting of the game species allowed by this Agreement and by state law, and for related activities such as scouting and habitat work approved by Landowner.
- Lessee and its members will comply with all federal, state, and local hunting laws, including licensing, tagging, season dates, and bag limits.
- No more than ________________ members may hunt under this Agreement. Lessee will give Landowner a current member list and update it when it changes.
- Guests may hunt only when accompanied by a member and only as allowed by the club rules, and the member is responsible for the guest.
5. Reserved rights of Landowner
Landowner reserves all rights not expressly granted, including farming, timber, grazing, oil, gas, and mineral activities, and access to the Property at any time. Landowner will make reasonable efforts to avoid interfering with hunting during open seasons.
6. Stands, blinds, food plots, and improvements
Lessee may place portable stands, blinds, feeders (where legal), and trail cameras, and may plant food plots in locations approved by Landowner. No permanent structures, tree cutting, road building, or ground disturbance beyond approved food plots without Landowner's written consent. Lessee will remove its personal property within 30 days after this Agreement ends.
7. Property care
- Use only existing roads and trails, and do not drive on roads when wet conditions would cause damage.
- Leave all gates as found, and lock any gate that was locked.
- Remove all trash, and do not dump animal carcasses where Landowner has not approved.
- No open fires except in approved areas.
- Lessee will repair or pay for damage caused by its members or guests.
8. Safety
Lessee will adopt written club rules that include firearm safety, hunter orange requirements as required by law, a sign-in/sign-out or check-in system so others know who is on the Property, and a prohibition on alcohol or drugs while hunting. Lessee will provide Landowner a copy of its rules.
9. Insurance
Before hunting begins, Lessee will obtain hunting lease liability insurance with limits of at least ________________ dollars per occurrence, naming Landowner as an additional insured, and will give Landowner a certificate of insurance. The coverage must stay in force for the full term.
10. Assumption of risk and indemnity
Lessee understands that hunting and being on rural land involve risks, including uneven terrain, water, wildlife, weather, and the actions of others. To the extent allowed by law, Lessee will defend, indemnify, and hold Landowner harmless from claims, damages, and expenses arising from the use of the Property by Lessee, its members, or guests, except those caused by Landowner's gross negligence or willful misconduct. Lessee will have each member and guest sign a liability waiver.
11. Assignment
Lessee may not sublease or assign this Agreement, or sell hunting rights on the Property, without Landowner's written consent.
12. Termination
Landowner may terminate this Agreement on written notice if Lessee or its members materially breach it, including game law violations on the Property, and Lessee will not be entitled to a refund. Either party may terminate by mutual written agreement. If the Property is sold, Landowner will give Lessee written notice and the parties will agree on a prorated refund unless the buyer assumes this Agreement.
13. General
This Agreement is the entire agreement between the parties and may be changed only in writing signed by both. It is governed by the laws of the State of ________________. If any part is found unenforceable, the rest remains in effect.
